The terms of use in this forum will be updated from time to time as the club grows, this TOU will always be the Terms of Use for the items here. It will supercede the TOU provided with the zips should that TOU differ from this one in anyway.

Commercial Use User License Agreement for SeAScrApS Products

These images are copyright © Sandra Adamson, 2008 (all rights reserved) also known as SeAScrApS. By downloading these graphic images and designs, you are agreeing to the terms of this user
license.

The following license will supercede any license presently within the zips of the graphics and images within the Commercial Use Club.

Personal Use:
You may use them in any way you desire for Personal Use provided you do not share, redistribute or sell the original, unaltered images in any form.

Commercial Use:
1. You may use any of my designs to modify or create new art and/or graphics.

2. You may resell your redesigned/modified images derived from my original images.

3. You may offer the kits you design using my Commercial Use items for S4O/S4H use to your customers.

4. You may not resell my original designs, embellishments, etc., either
individually or in a set for commercial use. If you use my elements to create a kit and like to sell that kit along with seperating the kit and selling it in peices-this is fine as long as the peices are stated 'personal use only', they can not be sold for commercial use purposes without written permission from me-in some cases if the modification is heavy enough I may allow this after seeing your end result.

5. You may not create or distribute PSP Paint Tubes using my Original Designs for commercial use.

6. You may not use my actions to create graphics that will be sold for commercial use to generate income. Ie: you may not use any of my actions to create the item in mass quantity and then bundle it in an element pack and sell it as a commercial use item. These actions are for kit design purposes only and must not exceed 30% off a kits contents. If you wish to use my actions in the above manner you must purchase my Commercial Use Sales License which is $25.00 a year and can be found under Services at the SFS store.

7. Stock Photos are copyrighted to me, please read the description area for each gallery-this will tell you usage restrictions if there are any. If you have any questions about usage please email me.

Please credit SeAScrApS (Sandra Adamson) with my blog site www.sandraadamson.blogspot.com and/or my store www.thedesignerstoolbox.com, in your Terms of use if you use these Graphics to generate income. Thank you.

LIMITATION OF LIABILITY

Under no circumstances, including negligence, shall Sandra Adamson (SeAScrApS) be held responsible for any damages or loss that result from the use of, or inability to use any if the products sold and/or distributed by Sandra Adamson and/or associated websites.
Whenever and wherever possible, the utmost care has been taken to ensure SeAScrApS designs do NOT infringe on copyright. If any legal action arises out of copyright infringement, Sandra Adamson shall be indemnified and held harmless of any and all costs and/or damages
that you, the purchaser and/or the digital store incur.

The TOU found in this forum will always be the most up to date terms of use for my graphics, it will supercede any TOU's found within the download zips.

Please note: #5 of the Graphics TOU does not apply to items in the S4O Club as you've paid a membership fee.
